Search Engines and SEO
- Submitting your site to a search engine does not guarantee that it will get listed. Search engine optimisation does not guarantee improved performance on search engines.
E-Commerce websites
- Our e-commerce websites support many but not all payment processing gateways, please check with us that yours is compatible. We are not responsible for dealing with payments or orders in any way. We use pre-made scripts for facilities like ‘product search’ (to make e-commerce sites more affordable). Although the design can be altered with these modules, the layout and function is limited so please check with us if you have any particular requirements (these must be mentioned on the statement of services or agreement)
Terms and Conditions
1. Acceptance
A signed statement must be provided by all new Customers at the time of submission of work to Fluid Studios WMS, indicating agreement to and acceptance of these Terms and Conditions. This acceptance covers all future work between the customer and Fluid Studios WMS.
2. Charges
Charges for services provided by Fluid Studios WMS
are negotiated prior to commencement of work and are
provided on a statement which must be signed by the
Customer. Fluid Studios WMS may request an advance
payment before work is supplied to the Customer for
preview. Quotes for services will be provided after
evaluation of the requirements submitted by the Customer.
Quotes remain valid for thirty (30) days from date
of preparation. Fluid Studios WMS reserves the right
to change the rates for services advertised within
this site without notice. Accounts that remain static for thirty (30) days may be invoiced at the discretion of Fluid Studios WMS.
3. Packages
Website packages do not include web hosting, domain
name registration, media content, database content,
shopping carts or any other additional features outside
of plain text and still graphics unless otherwise
mentioned. We may choose not provide any additional
service that has not been stated on the signed agreement
provided at the time of sale.
4. Payment
The Customer may elect to receive either e-mail or
hard copy invoices. Invoices are due on receipt. Accounts
that remain unpaid thirty (30) days after the date
of invoice may be charged interest at the standard
rate. Web pages may not be published until full payment
has been made. Accounts unpaid thirty (30) days after
the date of invoice may have any published web pages
produced by Fluid Studios WMS, removed. Removal of
such material does not relieve the Customer of its
obligation to pay any outstanding charges assessed
to the Customer's account. Cheques returned for insufficient
funds are assessed a return charge of £25. Customer's
Accounts that remain unpaid thirty (30) days after
the date of invoice, agree to pay Fluid Studios WMS
reasonable expenses, including legal fees and costs
for collection by third-party agencies, incurred by
Fluid Studios WMS in enforcing these Terms and conditions.
5. Termination
Termination of services by the Customer must be requested
in writing and will be effective on receipt of such
notice. Termination does not relive the Customer of
its obligation to pay for services already provided.
Customers who terminate the services during a partially
completed project will be charged for ammount completed.
E-mail or telephone requests for termination of services
will not be honoured. If hosting has been purchased
or a domain name has been registered by Fluid Studios
WMS in response to a request from the Customer, the
Customer must pay these fees even if termination is
requested.
6. Legal
Services provided by Fluid Studios WMS may be used
for lawful purposes only. Submission, transmission,
or maintenance of any information or materials in
violation of any government regulations is prohibited.
This includes, but is not limited to, material legally
judged to be threatening or obscene. Fluid Studios
WMS reserves the right to refuse service to the Customer
without providing reason or cause. Fluid Studios WMS
are not responsible for ensuring the compliance of
your website with UK or any other law, this is the
sole responsibility of the client. Any advice offered
by Fluid Studios WMS concerning the content of your
website should be checked with an independent legal
advisor.
7. Copyright
Customer retains the copyright to data, files and
graphic logos provided by the Customer, and grants
Fluid Studios WMS the rights to publish and use such
material. Custom artwork and graphic logos designed
by Fluid Studios WMS for use in the Customer's Web
presentation will remain the property of Fluid Studios
WMS; at its discretion, Fluid Studios WMS will grant
the Customer rights to use such material in formats
other than Web presentations. The Customer must obtain
permission and rights to use any information or files
that are copyright by a third party; the Customer
is further responsible for granting Fluid Studios
WMS permission and rights for use of the same and
agrees to indemnify and hold harmless Fluid Studios
WMS from any and all claims resulting from the Customer's
negligence or inability to obtain proper copyright
permissions.
8. Indemnity
The Customer agrees to indemnify and hold harmless
Fluid Studios WMS from any and all claims resulting
from the Customer's illegal or malicious use of Fluid
Studios WMS's services which cause damage to the Customer
or a third party.
9. Disclaimer
Fluid Studios WMS makes no warranties of any kind,
whether express or implied, for the services it provides.
Fluid Studios WMS also disclaims any warranty of merchantability
or fitness for a particular purpose. Fluid Studios
WMS will not be responsible for any direct, indirect
or consequential damages which may result from the
use of its services including loss of data resulting
from delays, non-delivery or interruption in service.
10. Support
Fluid Studios WMS will provide a basic level support
for the services that it provides. No support will
be provided for computer technical faults, e-commerce
facilities not mentioned in the original signed statement,
hosting or domain names that have not been provided
by Fluid Studios WMS and software not provided by
Fluid Studios WMS, including but not limited to, image
editing software, payment gateways or payment processing
facilities and internet browsers.
11. General
These Terms and Conditions supersede all previous
representations, understandings or agreements and
shall prevail notwithstanding any variance with terms
and conditions of any order submitted.
12. Search Engines
Fluid Studios WMS does not guarantee any results from
submitting a website address (URL) to a search engine
or from optimising a website for search engines results.
